RTM Advisory is a consultancy service providing advice to flat owners (i.e.
tenants, leaseholders etc.) on their ability to take over the responsibility
for the management of their building. The process is referred to as "Right
to Manage" (RTM) and was brought about by the Commonhold and Leasehold
Reform Act 2002. This right means that leaseholders can now insist on the transfer
of the landlord's management functions to a special company set up by them –
the Right to Manage company.
This was introduced, not just as a means of removing control from ineffective
landlords, but also to allow leaseholders to take responsibility for the management
of their block of flats. Though RTM can take a long
time to implement, it is a no fault procedure and leaseholders do not need
to prove any failing on the part of the landlord in respect of the management
of their property.
Whether the setting up of a Right to Manage company is the right
course of action for you will depend on a multitude of factors, the most
important being whether you are prepared and have the financial resources to
take on the financial responsibilities of managing your block of flats, either
directly or through the services of your appointed managing agent.
